Please read these documents carefully before using Apex POS. They govern your access to and use of our platform.

By accessing or using Apex POS, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Apex POS ("we", "us", "our"). By registering an account, accessing, or using any part of the Apex POS platform, you confirm that you have read, understood, and agree to be bound by these Terms.

If you are using the platform on behalf of a business, you represent that you have authority to bind that business to these Terms.


2. Use of the Platform

Apex POS provides a cloud-based, multi-tenant point-of-sale system designed for retail, hospitality, and similar businesses. You are granted a limited, non-exclusive, non-transferable license to access and use the platform for your internal business purposes in accordance with these Terms.

You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your login credentials confidential and not share them with unauthorized persons
  • Notify us immediately of any unauthorized access to your account
  • Use the platform only for lawful purposes and in compliance with applicable laws

3. Accounts & Subscriptions

Apex POS offers multiple subscription plans with different feature limits (users, products, branches). The specific limits for each plan are displayed at the time of subscription and may be updated from time to time.

Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except where required by applicable law. Downgrading your plan may result in loss of access to features or data that exceed the limits of your new plan.


4. Prohibited Activities

You must not:

  • Attempt to reverse-engineer, decompile, or disassemble any part of the platform
  • Use automated tools to scrape, crawl, or extract data from the platform without our written permission
  • Resell, sublicense, or otherwise transfer your access to any third party
  • Upload or transmit any malicious code, viruses, or harmful content
  • Use the platform in any way that could damage, disable, or impair the service

5. Intellectual Property

All content, design, code, trademarks, and materials on the Apex POS platform are the exclusive property of Apex POS or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without prior written consent.

Your business data entered into the platform (products, sales, customers) remains your property. We do not claim ownership of your data.


6. Limitation of Liability

To the maximum extent permitted by applicable law, Apex POS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the three (3) months preceding the event giving rise to the claim.


7. Termination

You may cancel your subscription at any time from your account settings. We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in activities that harm the platform or other users.

Upon termination, your right to access the platform ceases immediately. You may request a data export before account closure.


8. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the updated Terms.

1. Information We Collect

We collect information you provide directly to us, including:

  • Account information: name, email address, business name, and contact details
  • Business data: products, pricing, inventory, sales records, and customer data you enter into the platform
  • Payment information: billing details processed securely through our payment providers
  • Usage data: logs, IP addresses, browser type, and interaction patterns with the platform

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Apex POS platform
  • Process transactions and send related information (receipts, invoices)
  • Send technical notices, security alerts, and support messages
  • Respond to your comments, questions, and customer service requests
  • Monitor and analyze usage trends to improve user experience

We do not sell your personal data to third parties.


3. Data Storage & Security

Your data is stored on secure servers. We implement industry-standard security measures including encryption in transit (TLS), access controls, and regular security audits to protect your information against unauthorized access, alteration, or loss.

While we strive to protect your data, no method of transmission over the Internet is 100% secure. We cannot guarantee absolute security.


4. Sharing of Information

We may share your information only in the following circumstances:

  • With service providers who assist us in operating the platform (e.g. cloud hosting, payment processing) under strict confidentiality agreements
  • When required by law, court order, or governmental authority
  • In connection with a merger, acquisition, or sale of assets, with appropriate notice to you

5. Cookies

Apex POS uses cookies and similar technologies to maintain your session, remember your preferences, and improve platform performance. Essential cookies are required for the platform to function. You may disable non-essential cookies through your browser settings, though this may affect some functionality.


6. Your Rights

Depending on your location, you may have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your data (subject to legal retention requirements)
  • Export your business data in a portable format
  • Object to certain processing of your personal data

7. Data Retention

We retain your account and business data for as long as your account is active, and for a reasonable period afterward to allow for account reinstatement or legal compliance. When you close your account, we will delete or anonymize your personal data within 90 days, unless longer retention is required by law.

We may update this Privacy Policy periodically. We will notify you of significant changes via email or a platform notice. The date at the top of this page reflects the most recent update.
